Obtaining Permission to Establish a Link
Any request for linking to the Elias/Savion ® web site (“Linking Request”) must
be sent to Joanne Beardslee for approval before activating any link (Joanne.Beardslee@Elias-Savion.com).
Your Linking Request must include the name, address, telephone number, contact
name, e-mail address and web site address of your company or the company whose
web site you intend to link (“Your Web Site”). If Your Web Site is not yet
operational, you must also send a description of the nature of the content to
be displayed on Your Web Site, and a description of the company and its
services and/or products. If Your Web Site is password or otherwise protected,
you must grant Elias/Savion access to Your Web Site. Elias/Savion has the
right, but not the obligation, to review Your Web Site and its content, but any
such review does not constitute endorsement. If Elias/Savion agrees to your
Linking Request, you will be notified by e-mail. When Elias/Savion approves
your Linking Request, Elias/Savion grants to you a non-exclusive, limited,
non-transferable right to establish a link to the Web Site using one of the
methods described below under “Establishing a Link.” Your establishment of any
link to the Web Site signifies your agreement to this Linking Policy. Upon
acceptance of your Linking Request, this Linking Policy becomes a legally
binding agreement between you and Elias/Savion, and becomes part of the
Elias/Savion Web Site Terms of Use Agreement. In the event of any conflict
between this Linking Policy and the Terms of Use Agreement, this Linking Policy
will prevail as applied to the subject matter of this policy.
Establishing a Link
There are three acceptable ways to link the Elias/Savion Web Site at
Elias/Savion.com once your Linking Request has been accepted by Elias/Savion.
They are:
1.FULL ELIAS/SAVION GRAPHIC
A full Elias/Savion graphic is the preferred method of linking to the Web Site.
The graphic appears with the Elias/Savion name and registration mark®.
2.LOGO BUTTON
A logo button provided below may be linked to the Web Site.
3.TEXT-BASED LINK
You may link from a text-based reference to Elias/Savion if the reference
contains uppercase “ELIAS/SAVION”. The reference must also contain the
registration mark. Or you may write out the URL as:
www.Elias-Savion.com
Restrictions
No changes or modifications to the Elias/Savion Graphic, Logo Button, domain
name, or Elias/Savion trademark are permitted. The Elias/Savion Graphic, Logo
Button, domain name and trademark, if used, must be reproduced as described and
displayed above including use of above-identified PMS colors and use of the
registration mark next to Elias/Savion in each instance. Use of the
Elias/Savion Graphic, Logo Button, domain name, or any Elias/Savion trademark
for purposes other than linking to the Web Site is expressly forbidden.
Approved links to the Web Site may link to, but not replicate, the Web Site’s
content. The Elias/Savion domain name, Graphic, Logo Button, and any
Elias/Savion trademark may not be used or associated with any obscene,
scandalous, inflammatory, pornographic, indecent, profane, defamatory or
unlawful site or materials in any way, or in any manner that Elias/Savion, in
its sole discretion, believes would adversely affect the name, reputation or
goodwill of Elias/Savion, its services, products, affiliates, trading partners,
employees, officers, directors, service providers or representatives.
Elias/Savion reserves the right to revoke its permission to establish a link
(as described above) at any time and for any reason or no reason. If
Elias/Savion notifies you of such revocation, you must immediately cease all
use of the Elias/Savion Graphic, Logo Button, domain name and trademarks and
terminate the link between the Web Site and Your Web Site.
Intellectual Property
Elias/Savion retains and reserves all rights, title, and interest in and to
Elias/Savion’s trade names, trademarks, logos, and domain names, including
without limitation the Elias/Savion Graphic and Logo Button, and all related
copyrights and other intellectual property rights. Elias/Savion’s Intellectual
Property rights are further described in the Elias/Savion Web Site Terms of Use
Agreement.
No Endorsement
The establishment of any link between the Web Site and any other site does not
constitute or imply any endorsement by Elias/Savion of Your Web Site or any
third-party sites, or the products, content, materials or information presented
or made available by such sites. You acknowledge and agree that Elias/Savion,
its affiliates, trading partners, employees, officers, directors, service
providers and representatives, are not responsible for any damages or losses
caused or alleged to have been caused by the use of any third-party sites, or
from the products, content, material or information presented by or available
through those sites, or related in any way to any link between the Web Site and
Your Web Site.
General
All the terms and conditions of the Elias/Savion Elias/Savion Web Site Terms of
Use Agreement that are not expressly modified or supplemented by this Linking
Policy apply to the subject matter of this policy, including but not limited
to: “Disclaimer of Warranties,” “Limitation of Liability,” “Content and Other
Information,” and “Downloading and Using Content.” Elias/Savion reserves the
right to modify this Linking Policy at any time by posting such modifications
to the Web Site. Your continued maintenance of any active link to the Web Site
or use of the Elias/Savion Graphic, Logo Button, domain name, or any
Elias/Savion trademark in connection with such link shall signify your
agreement to such modifications. We encourage you to periodically review the
posted Linking Policy. You may at any time print, download and/or store a copy
of this Linking Policy. If you experience any difficulty in printing,
